The firearms data infrastructure in the United States is severely limited in scope and fragmented in nature. Improved data systems are needed in order to address gun violence and promote productive conversation about gun policy. In the absence of federal leadership in firearms data systems improvement, motivated states may take proactive steps to stitch gaps in data systems. We propose that states evaluate the gaps in their systems, expand data collection, and improve data presentation and availability.

While information structure has traditionally been viewed as a singlepartition of information within an utterance, there are opposing viewsthat identify multiple such partitions in an utterance. The existenceof alternative proposals raises questions about the notion ofinformation structure and also its relation to discoursestructure. Exploring various linguistic aspects, this paper supports thetraditional view by arguing that there is no information structure partition within a subordinate clause.

Abstractabstract:Interpreters of John Stuart Mill's moral philosophy have long disagreed about whether he was an act or rule utilitarian. Though debate has often focused on Utilitarianism, this paper instead analyzes a less studied work, "Whewell on Moral Philosophy," which contains a more detailed and systematic discussion of moral rules. "Whewell," I argue, favors reading Mill as an act utilitarian: it understands the importance of rules in moral reasoning to arise from the uncertainty under which human action occurs, not from any (...) direct role that rule compliance plays in determining right action. This dissertation analyzes three legal doctrines that regulate unintentional aspects of criminal conduct. Chapter one defends the influence the law grants to an action’s unintended results in determining the extent of the agent’s criminal liability. First, I critique the argument that criminal law’s general mens rea requirement allows a result to affect the extent of a defendant’s criminal liability only if he possesses mens rea with respect to that result. The rules that define offenses and the rules that specify sentences (...) for individual criminal actions each guide conduct, but they do so differently. Effective offense definitions must be framed in terms of mental states, but effective sentencing rules need not be; therefore, mens rea must set the limits of liability, but the extent of liability need not depend on mens rea alone. Second, I argue that sentencing rules can most effectively guide offenders to reduce the risk that their offenses will unintentionally cause harm if those rules grade the seriousness of each offense based on its results, since the primary alternative, grading offenses based on their risk, requires methods of measuring and communicating risk that exceed the capacities of the criminal justice system. While chapter one addresses the extent of liability, chapters two and three address its scope: each presents an account of one of the two types of mens rea used to define unintentional crimes. Recklessness, the subject of chapter two, is often analyzed as requiring defendants to possess a belief (or similar mental state) directed towards the degree of risk an action creates. Defining offenses in terms of an agent’s beliefs about risk, however, guides individuals to evaluate actions in deliberation by estimating the degree of risk they create. And because individuals ordinarily cannot estimate risks accurately, such rules will not effectively guide them to reduce harm. Effective rules, I will argue, must identify prohibited actions in a different way—namely, through the features of those actions that make them unreasonably risky. The definition of recklessness does not itself identify those features directly; instead, by requiring individuals to comply with the standard of conduct of the law-abiding person, recklessness indirectly incorporates into law the social norms that regulate dangerous activities. To be reckless, then, defendants must recognize the features of their conduct in virtue of which it violates such a norm. Finally, chapter three analyzes negligence. Criminal negligence is paradoxical: even though culpability ordinarily requires advertence, negligent defendants are typically understood to be culpable for a risk they inadvertently create. Rather than rejecting culpability for negligence or expanding culpability beyond advertence, I dissolve the paradox by reconceptualizing negligence. Negligent defendants are culpable despite their failure to perceive one risk because they advert to a different risk—the risk that by failing to inquire before acting they will fail to uncover evidence of the risk that they do, in the end, actually fail to perceive. Negligence is epistemic recklessness, the culpable disregard of the risk of inadvertently performing a risky action. Though negligence, like recklessness, involves advertence to risk, it constitutes a distinct form of mens rea because it regulates a different aspect of conduct—the decision to inquire rather than the decision to act. And because omitting inquiry creates only a risk of a risk, negligence is systematically less risky than recklessness, and therefore less culpable. (shrink)

It is often assumed that concepts from the formal sciences, such as mathematics and logic, have to be treated differently from concepts from non-formal sciences. This is especially relevant in cases of concept defectiveness, as in the empirical sciences defectiveness is an essential component of lager disruptive or transformative processes such as concept change or concept fragmentation. However, it is still unclear what role defectiveness plays for concepts in the formal sciences. On the one hand, a common view sees formal (...) concepts to be protected against defects because of their precise and stable nature. On the other, studies going back as far as Lakatos (1963) showcase the changeability of such concepts. -/- In this paper, I will investigate if and how defectiveness based on the occurrence of inconsistencies can appear with formal concepts. To make the case as strong as possible, I employ a strict notion of formal concept that assumes the concept to have a fixed and definite extension. I will show that there are indeed certain types of defectiveness that cannot occur with such concepts; but that there are other types of defectiveness that do occur. This means that while formal concepts have to be treated differently than non-formal concepts, questions about defectiveness---as raised in the conceptual engineering debate and philosophy of science---can still be applied to them. I will highlight this point by showing how formal sciences have special strategies available to them that allow them to resolve defectiveness of their concepts in a flexible and informative manner. This clearly presented study examines the nature of religious experiences, and asks whether they can be used as evidence for religious beliefs. The author discusses important philosophical issues raised by religious experience, such as the role of models and metaphors in their description, and the way experiences in general are used as evidence for claims about the world. Using contemporary and classic sources from the world's religions, the author gives an account of different types of religious experience. She also draws (...) extensively on psychological, sociological, and philosophical literature to meet sceptical challenges, and concludes that, like most experiences, they are most effective as evidence within an argument which combines evidence from a wide range of sources. We survey recent developments in the theory of class forcing for- malized in the second-order set-theoretic setting.

The National Library of France owns an uncommon illuminated manuscript of the Book of Job : the Parisinus graecus 135. Written in Greek in 1361/62, it is illustrated with a very large iconographic cycle , which combines Byzantine and gothic styles. The examination of the historical background allows us to bring forth the general meaning of the manuscript and to locate its origin with some probability in the Papal entourage and the Byzantine latinophile circles. The analysis of the iconographic cycle (...) of the manuscript shows that it is likely inspired by the theology developed in the literal commentary of Thomas of Aquinas on the Book of Job. Remarkably, this author is intensively translated in Greek in the middle of the fourteenth century in Byzantium under the aegis of the Emperor John VI Cantacuzenus. (shrink)

Previous research indicates that the depletion of self-regulatory resources can promote unethical behavior that benefits the self. Extending this literature, we focus on norm-transgressing behavior that is intended to primarily benefit others. In particular, we predicted a differing effect of self-regulatory resource depletion on dishonesty that benefits one’s group, depending on the degree of identification with the group. Following a dual process approach, we argue that if identification with the group is strong, then people may have an automatic inclination to (...) benefit their group even perhaps by lying. In contrast, if identification with the group is weak, then the default, uncontrolled impulse may be to tell the truth. Accordingly, identification with the social group should interact with self-regulatory resource depletion in predicting group-benefiting dishonesty. Focusing on pro-organizational dishonesty, we tested our hypotheses in one field study with 1269 employees and in one experimental study with 71 university students. As predicted, the results revealed a highly significant interaction of organizational identification and self-control strength: Depletion of self-regulatory resources increased the level of pro-organizational dishonesty among those who identify highly with the organization, but decreased the level of such behavior among those who identify less. Feminists are often "up against Foucault" because he questions key conclusions in feminism regarding the nature of gender relations, and men's possession of power. This book, however, fills the gap in literature about Foucault by showing how his theories of sexuality and power relations are often applicable to the everyday realities of women's lives. Drawing upon their diverse backgrounds (...) in social theory and philosophy, the contributors discuss the ways in which Foucault provokes feminists into questioning their grasp of power relations, and examines the implications of his decision to overlook categories of gender in his discussion of sexuality and power relations. A central area of current philosophical debate in the foundations of mathematics concerns whether or not there is a single, maximal, universe of set theory. Universists maintain that there is such a universe, while Multiversists argue that there are many universes, no one of which is ontologically privileged. Often model-theoretic constructions that add sets to models are cited as evidence in favour of the latter. This paper informs this debate by developing a way for a Universist to interpret talk that (...) seems to necessitate the addition of sets to V. We argue that, despite the prima facie incoherence of such talk for the Universist, she nonetheless has reason to try and provide interpretation of this discourse. We present a method of interpreting extension-talk (V-logic), and show how it captures satisfaction in `ideal' outer models and relates to impredicative class theories. We provide some reasons to regard the technique as philosophically virtuous, and argue that it opens new doors to philosophical and mathematical discussions for the Universist. (shrink)

A cause is proportional to its effect when, roughly speaking, it is at the right level of detail. There is a lively debate about whether proportionality is a necessary condition for causation. One of the main arguments against a proportionality constraint on causation is that many ordinary and seemingly perfectly acceptable causal claims cite causes that are not proportional to their effects. In this paper, I suggest that proponents of a proportionality constraint can respond to this objection by developing an (...) idea that is present in Yablo’s early work on proportionality, but which has strangely been ignored by both Yablo and others in the subsequent debate. My suggestion is that proportionality—and, indeed, causation itself—is relative to a domain of events. At the metaphysical level, this means that the causal relation has an extra relatum—namely, a domain of events. At the level of language, it introduces a new way in which causal claims are context-sensitive: what is expressed by a causal claim depends on the contextually relevant domain of events. As I argue, this suggestion allows us to accommodate the truth of ordinary causal claims while extending the explanatory benefits of a proportionality constraint. (shrink)

In this article, I argue for the notion of what I term ‘uncanny water’ as a conceptual tool for reading contemporary oceanic fictions. The uncanny’s affective capacity to destabilise epistemological and ontological certainties makes it a particularly potent literary tool for challenging the nature/culture binary. I argue that fictions which actively defamiliarise the ocean can be used to redress the anthropocentric privilege found in hitherto narratives of the oceanic that were predicated upon mastery and control, and that uncanny moments of (...) displacement and uncertainty can illuminate human/oceanic interconnections and foster a sense of responsibility and compassion towards the oceans. I identify resonances between the uncanny’s continuing referentiality and the notion that feminist transcorporeality interrelates the subject into networks of materiality which extend across time and space in unknowable ways. Both transcorporeality and the uncanny work against the conceit of the individual through the dissolution of boundaries, and, crucially, both require a suspension of assumptions of the self as whole, discrete and impermeable. To demonstrate this, I read the uncanny waters of contemporary fictions from the Northern Atlantic Littoral (Atlantic Canada and the westernmost parts of the UK). The littoral position of these spaces makes them ideally placed to negotiate the borders between habitable and unhabitable spaces, and the limitations of knowledge that run alongside this. I assert that iterations of uncanny water offer a transoceanic dialogue which shifts constructions of subjectivity away from national and terrestrial boundaries to one more akin to the fluid and relational dialectics of transcorporeality. This paper explores the history of ELIZA, a computer programme approximating a Rogerian therapist, developed by Jospeh Weizenbaum at MIT in the 1970s, as an early AI experiment. ELIZA’s reception provoked Weizenbaum to re-appraise the relationship between ‘computer power and human reason’ and to attack the ‘powerful delusional thinking’ about computers and their intelligence that he understood to be widespread in the general public and also amongst experts. The root issue for Weizenbaum was whether human thought could be ‘entirely computable’. (...) This also provoked him to re-consider the nature of machine intelligence and to question the instantiation of its logics in the social world, which would come to operate, he said, as a ‘slow acting poison’. Exploring Weizenbaum’s 20th Century apostasy, in the light of ELIZA, illustrates ways in which contemporary anxieties and debates over machine smartness connect to earlier formations. In particular, this article argues that it is in its designation as a computational therapist that ELIZA is most significant today. ELIZA points towards a form of human–machine relationship now pervasive, a precursor of the ‘machinic therapeutic’ condition we find ourselves in, and thus speaks very directly to questions concerning modulation, autonomy, and the new behaviorism that are currently arising. Among the available metaethical views, it would seem that moral realism—in particular moral naturalism—must explain the possibility of moral progress. We see this in the oft-used argument from disagreement against various moral realist views. My suggestion in this paper is that, surprisingly, metaethical constructivism has at least as pressing a need to explain moral progress. I take moral progress to be, minimally, the opportunity to access and to act in light of moral facts of the matter, whether they are mind-independent (...) or -dependent. For the metaethical constructivist, however, I add that moral progress ought also mean that agents come to be or could come to be motivated to act in light of the right kind of moral judgments. Together I take this to mean that, for all forms of constructivism, moral progress must be explained as a form of moral improvement, or agents aspiring to be better sorts of moral agents. In what moral improvement consists differs for various forms of constructivism. Here I distinguish between three different versions of metaethical constructivism: Humean constructivists as represented by Street, Kantian constitutivist constructivists as represented by Korsgaard, and constructivists about practical reason as represented by Carla Bagnoli. I conclude by showing that only constructivism as a view about practical reason can fully account for moral progress qua the opportunity for moral improvement. (shrink)

Research in the U. S. on fair trade consumption is sparse. Therefore, little is known as to what motivates U. S. consumers to buy fair trade products. This study sought to determine which values are salient to American fair trade consumption. The data were gathered via a Web-based version of the Schwartz Value Survey (SVS) and were gleaned from actual consumers who purchase fair trade products from a range of Internet-based fair trade retailers. This study established that indeed there are (...) significant interactions between personal values and fair trade consumption and that demographics proved to be useless in creating a profile of the American fair trade consumer. In Sect. 1, we set the stage by briefly discussing the opposition between the ‘universe view’ and the ‘multiverse view’. Furthermore, we propose to classify multiverse conceptions in terms of their adherence to some form of mathematical realism. In Sect. 2, we use this classification to review four major conceptions. Finally, in Sect. 3, we focus on the distinction between actualism and potentialism with regard to the (...) universe of sets, then we discuss the Zermelian view, featuring a ‘vertical’ multiverse, and give special attention to this multiverse conception in light of the hyperuniverse programme introduced in Arrigoni-Friedman :77–96, 2013). We argue that the distinctive feature of the multiverse conception chosen for the hyperuniverse programme is its utility for finding new candidates for axioms of set theory. (shrink)

In this essay, Lundquist underscores the need for a more inclusive phenomenology of pregnancy. Drawing on sources in literature, psychology, and phenomenology, she offers descriptions of the cryptic phenomena of rejected and denied pregnancy, indicating the vast range of pregnancy experience and illustrating substantial phenomenological differences between “chosen” and unwanted pregnancies.

Penelope Maddy’s Second Philosophy is one of the most well-known ap- proaches in recent philosophy of mathematics. She applies her second-philosophical method to analyze mathematical methodology by reconstructing historical cases in a setting of means-ends relations. However, outside of Maddy’s own work, this kind of methodological analysis has not yet been extensively used and analyzed. In the present work, we will make a first step in this direction. We develop a general framework that allows us to clarify the procedure and (...) aims of the Second Philosopher’s investigation into set-theoretic methodology; pro- vides a platform to analyze the Second Philosopher’s methods themselves; and can be applied to further questions in the philosophy of set theory. This paper builds on existing research investigating CSR and ethical consumption within luxury contexts, and makes several contributions to the literature. First, it addresses existing knowledge gaps by exploring the ways in which consumers perform ethical luxury purchases of fine jewellery through interpretive research. Second, the paper is the first to examine such issues of consumer ethics by extending the application of theories of practice to a luxury product context, and by building on Magaudda’s :15–36, 2011) circuit of practice framework. (...) This is significant in that, to date, consumer research using practice theories has focused mainly on routine and habitual practices. Our findings and discussion provide an analysis of intentional and less intentional ethical consumer performances within the interconnected nexus of activities of consumers’ fine jewellery consumption practice, where meanings, understandings and intelligibility of social phenomena are worked through the various activities that shape such a practice. Finally, the paper concludes with significant managerial and policy-related implications, as our extended circuit of practice analysis conveys that if ethics and sustainability dimensions are to be embedded in fine jewellery consumption practice, they must first be made an intrinsic part of the nexus of the social and material environment of trading and consumption places. In the late 1940s and early 1950s Lorenzen developed his operative logic and mathematics, a form of constructive mathematics. Nowadays this is mostly seen as the precursor to the more well-known dialogical logic and one could assumed that the same philosophical motivations were present in both works. However we want to show that this is not always the case. In particular, we claim, that Lorenzen’s well-known rejection of the actual infinite as stated in Lorenzen (1957) was not a major motivation (...) for operative logic and mathematics. In this article, we claim that this is in fact not the case. Rather, we argue for a shift that happened in Lorenzen’s treatment of the infinite from the early to the late 1950s. His early motivation for the development of operativism is concerned with a critique of the Cantorian notion of set and related questions about the notion of countability and uncountability; only later, his motivation switches to focusing on the concept of infinity and the debate about actual and potential infinity. We provide an account of chimpanzee-specific agency within the context of philosophy of action. We do so by showing that chimpanzees are capable of what we call reason-directed action, even though they may be incapable of more full-blown action, which we call reason-considered action. Although chimpanzee agency does not possess all the features of typical adult human agency, chimpanzee agency is evolutionarily responsive to their environment and overlaps considerably with our own. As such, it is an evolved set of capacities (...) for goal-directed behavior, which solves problems that chimpanzees naturally encounter.
